This may be an anachronistic question. I know a big debate in the 14th amendment is about whether it originally was meant to apply the bill of rights to the states.
Whenever you hear of people “pleading the 5th” is it not assumed that the bill of rights has been applied universally and even in state, local courts? Perhaps the use of this phrase is a recent phenomenon?
