Just a quick question on the impeachment process…

For sake of argument… Let’s say that Boehner had the House vote and pass impeachment proceedings…

Can Harry Reid block it and keep it from ever being an issue in the Senate. Or is the Senate duty bound to at least have the trial which I am sure there wouldn’t be the votes to remove the President?

    Thanks in advance,

    John

    John,

First, the target of an impeachment proceeding need not be a president: a Supreme Court justice, numerous lower-ranking judges, and several Cabinet officers have been impeached.

As I read the Constitution, the trial is mandatory. Besides that, as the Democrats would stand to gain from having it, I can’t imagine Reid not proceeding.

Thanks Professor…. Just wanted clarification… Wasn’t sure if the Senate could choose to ignore the House or not.
