Could the President Release the people currently held in the Guantanamo Bay Detention Facility under the constitutional “Pardon Power”?
Certainly. The reason they are held at Gitmo is so that they will fall under the president’s power to detain foreign combatants as commander-in-chief of the US Military, so he could release them at any point if he wanted to do so.
Excellent! I thought so, but I wanted to be sure before I brought up the issue the next time I discussed it.
