    What are we to make of the idea that the due process clauses in the Bill of Rights prove that the Constitution was intended to provide for federal criminal law?

    As always, I very much appreciate the time the faculty dedicates to answering questions.

    There would of course be some criminal law under the Article I, Section 8 powers, as counterfeiting, treason, sedition, etc., must be punished.
