So, essentially, its a utilitarian approach?

I am in no way a legal scholar, in any sense of the word. My academic experience has been purely business-related (accounting). Your book has been my first real brush with the topic of Constitutional law. That being said, I defiantly understand and-as a principle-agree with the idea of Article III and the 10th Amendment.

But that nagging question keeps coming back for me. What should of happened? If the State of Georgia stood on the concept of “we can’t be taken to court unless we consent” seems problematic. Should the South Carolinian just taken his lumps and said “well, live and learn.” I guess it all flies in the face of what I’ve learned is the Libertarian stance on Gov’t. That its main role (if any) should be to protect private property. I appreciate, you Professor Gutzman, helping me figure this out.

Just to continue the conversation. Where do you think the NAP would fall in Kohlberg’s Theory of Moral Development?

Wonderful. That should be sufficient to get me started. Thanks all!

Thanks Ess and Sons. I will check out that book. What I’m looking for is more then just the elevator speech on it. I understand the summary, but would like to get more literature on a more detailed explanation. I’ll check out that Rothbard book.

I agree with you, Clint, on many aspects. It seems the earlier lectures were the trial-n-error, phase (Early American history) but as they progressed, they get much better. I found it best if you approach LC as an additional learning source. Some lectures seem to require a certain amount of prior knowledge. Not much different to how college and university courses are. For example, the lectures on Civil war focus mainly on the political aspect and not so much the battles fought. Though, I have to say, the political aspect was what I was mostly interested in anyway.

I do find the forums board rather cumbersome. Software like Vbulletien would allow more editing and less “bare bones” approach to discussion boards. But this is how things go with newer sites. I think with time, and an ear to the consumer, LC will get better each year. I plan to continue purchasing subscriptions as long as it seems that things are improving, and not staying stagnant.

I do find it interesting, that I very seldom see these sort of “thought experiments” applied to other political stripes. It seems that Libertarians are the only ones who are poked and prodded.

Anyway, wouldn’t there be a large amount of value of having another person on the island? To help with work and what not. Seems sharing a banana would be a small price to pay for splitting the work load. Just my opinion.

Yea, I’ve seen it more then once. However, its only been as a passing “fact” and never with any real footnote or citation. Just figured I’d ask.

I would like to see how this conversation goes as well. I recall a sermon a while back where the pastor said something about rights and how they play into the bible. It was some time ago, but I think one of the points was that assuming one is entitled to a “right” assumes they can demand such and therefore are focusing on self, rather than the glory of God. I suppose it comes back to being a servant, or a slave to God. It’s something I’ve personally been thinking a lot about. Coming to terms with your faith and personal beliefs. I would love to hear others thoughts.

Really? That’s a bummer. I did see the link though on the “Live Session” part of the site. Maybe it automatically put it up there?
